Federal delivery-sale requirements

The PACT Act covers electronic nicotine delivery systems (ENDS), including certain devices, liquids, components, and accessories. Coverage is broader than nicotine-containing products alone.

Age verification and delivery

Applicable delivery sales require age verification and an adult recipient with identification at delivery. Tobacco sales to people under 21 are prohibited. Delivery requirements include obtaining the required adult signature and checking identification; an online age confirmation alone does not replace these safeguards.

Shipping restrictions

Covered shipments require tobacco-product package labeling. Ordinary consumer vape shipments through USPS are generally prohibited, subject to limited statutory exceptions. Carrier availability does not establish that a shipment is legal.

Registration, taxes, and records

Applicable sellers must meet registration, reporting, tax, and recordkeeping obligations, along with destination restrictions. Publishing this page does not establish compliance or confirm this website’s registrations, carrier arrangements, or delivery procedures.

See ATF’s official guidance. This information does not expand delivery availability or authorize prohibited sales.
